In its complaint, Tool claims that Volcano failed in April to exercise an option to renew its recording pact — which the band considered to be a technical default of its deal — and is now free to seek a pact elsewhere.

The label allegedly failed to advise the band in writing that it was moving into the next contract period. But lawyers for the band claim a new option was never exercised, and its lawsuit points to previous contract renewals that were exercised by written notice from the label to the band. Home Biz News.
